Through this Privacy Notice (the "Notice"), and pursuant to the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations and other applicable provisions in Mexico (collectively, the "Law"), we describe the terms under which the Personal Data (as defined below) that you (the "Data Subject") provide us by any means will be obtained, used, disclosed or stored (any of those actions individually or jointly, the "Processing").
Representaciones Artísticas Apodaca, S.A. de C.V. ("Apodaca" or "we"), as the data controller as defined by the Law, domiciled at Av. Jerónimo Treviño Oriente 1549, Monterrey Centro, 64000, Monterrey, Nuevo León, establishes the aforementioned address for all purposes related to this Notice.
At Apodaca we are committed to protecting the privacy of Data Subjects. The term "Data Subject(s)" refers to any individual who, by any means, provides us with one or more items of their Personal Data for the purposes described in this Notice.
1. Purposes for processing your Personal Data through our platform, website and/or applications
We collect a broad range of information about you ("Personal Data"). The purposes for which we use this information are listed below. If we process your information for any additional purpose, we will inform you at the relevant time.
1.1 Identification and age verification
This purpose refers to confirming the identity of the Data Subject as necessary to comply with this Notice, and it may involve verifying the Data Subject's legal age before granting access to Apodaca's official pages, applications and platforms and/or before the Data Subject participates in activities promoted or organized by Apodaca, whether in person or online.
1.2 Offering products and services
This purpose refers to various activities carried out by Apodaca, its affiliates and/or subsidiaries to offer, market, personalize and improve our products and services; enter into, maintain and perform a commercial and/or business relationship with the Data Subject; and create, update and manage the Data Subject's account on our official websites, platforms and applications.
1.3 Maintaining and optimizing our official websites, platforms and applications
This purpose covers situations in which we must resolve performance issues affecting our applications, platforms and official websites, including troubleshooting, data analysis, testing, system maintenance, support, reporting and data storage, improving the availability of our official websites, platforms and applications, and protecting them against any kind of fraud or misuse.
1.4 Participation in events and promotions
This purpose refers to the participation of the Data Subject in purchase promotions, raffles and contests (including giveaways) held in person, online, via mobile devices, social networks and applications, as well as in geolocation-based activities and promotions (including SMS messaging and gamification).
1.5 Compliance with the Law
This purpose refers to the Processing of Personal Data of Data Subjects when necessary to comply with a legal obligation or requirement, or with a recommendation from an authority to which Apodaca, its affiliates or subsidiaries are subject, including the disclosure of Personal Data to governmental or supervisory authorities such as tax, administrative and/or judicial bodies.
1.6 Customer service
This purpose includes activities such as addressing and following up on the Data Subject's questions, complaints or comments regarding our products and/or services—therefore phone calls, emails or any communications between the Data Subject and Apodaca may be recorded—extending invitations to events or recommending products and services that might interest or benefit you, and evaluating the quality of our products and/or services and performing satisfaction surveys.
1.7 Marketing profiles
This purpose covers the activities we perform to improve our marketing strategies by creating audience segments and profiles so we can send tailored offers and content, particularly when we use Personal Data management platforms or receive Personal Data from social media platforms. The Data used for these purposes may be encrypted and later decrypted either by us or by third parties.
1.8 Advertising and marketing
This purpose references activities such as sending promotional information about our products and developing and delivering marketing or advertising campaigns to offer products and/or services from Apodaca, its affiliates, subsidiaries and/or business partners.
If you do not want your Personal Data to be Processed for non-essential purposes, you may send an email to [email protected] at any time expressing your refusal for those purposes. Refusing the use of your Personal Data for non-essential purposes will not be grounds for us to deny you any of our products or services.
Apodaca Processes the Personal Data of Data Subjects only for as long as it remains valid and/or Processing is necessary to fulfill Apodaca's purposes and/or a legal obligation.
2. Types of Personal Data subject to Processing
To carry out the purposes described in this Privacy Notice, we will collect and Process your Personal Data belonging to the following categories, as necessary:
- Identification data such as name, age and similar information.
- Contact data such as email address and similar information.
- Data related to physical characteristics, such as facial features and in general any information related to an individual's specific physical traits.
Additionally, we collect information about how you use our products, services, and official websites, platforms and applications, such as IP address, cookies, mobile device ID, login data, browsing history, browser type and version, clicks, time zone settings and location, pages visited (including date and time logs), plug-in types and versions in your browser, operating systems, platforms and information from other technologies on the devices you use to access our official websites, platforms and applications.
This also includes any information you share with Apodaca through your social networks if you use them as a registration method on our official websites, applications and platforms.
We also collect, use and share De-identified Personal Data ("De-identified Data"), such as statistical and demographic information, to fulfill any of the purposes described in this Notice. De-identified Data may originate from certain Personal Data but is not considered Personal Data under the applicable regulation because it cannot be associated with the Data Subject or used to identify them due to its structure, content or aggregation level. However, if we combine or connect De-identified Data with your Personal Data to the point that such data could identify you directly or indirectly, the combined information will be treated by us as Personal Data and therefore handled in accordance with this Privacy Notice.
If you provide Apodaca with Personal Data other than those indicated in this Notice, and such Data are consistent with the purposes described herein, Apodaca may Process that Data solely to fulfill the stated purposes, with the delivery of such Data being understood as your consent for us to carry out the Processing.
3. Means by which we obtain your Personal Data
We obtain your Personal Data directly when you provide it in person or through electronic means such as email, our official websites, applications, platforms and/or social networks, or by phone; and indirectly, when we receive Personal Data from a third party or from a social media platform or media outlet.
Apodaca may collect Personal Data at the beginning of the legal or commercial relationship with the Data Subject or during its term and development. Any Personal Data collected during the relationship will be Processed in accordance with this Privacy Notice.
4. Who has access to your Personal Data
Apodaca personnel will only access your Personal Data when necessary to perform their work or to fulfill any of the purposes described in this Notice.
We may need to share your Personal Data with third parties to fulfill any of the purposes described in this Notice. Those third parties are:
- Apodaca's affiliated and/or subsidiary companies, in order to centrally provide different processes and services derived from the national and international nature of the information technology systems shared among companies.
- Third-party providers of products or services, which may include marketing services, advertising, marketing service platforms, digital marketing strategies, the development and design of contests, raffles and sweepstakes, and information technology systems.
- Professional advisors such as accountants, auditors or attorneys.
- Governmental authorities in order to comply with any legal or judicial obligation.
The aforementioned third parties may be located in Mexico or anywhere else in the world. When your Personal Data are stored outside Mexico, we will make sure they have an adequate level of protection. We require our service or product providers and professional advisors to implement and maintain appropriate security measures to preserve the safety and confidentiality of your Personal Data through strict standards and legal agreements.
5. Security
We will establish and maintain administrative, technical and physical security measures to protect your Personal Data against damage, loss, alteration, destruction or unauthorized use, access or Processing, taking into account potential risks. These measures will always align with legal and industry standards.
6. Retention periods for your Personal Data
We will retain your Personal Data for as long as legally permitted, while they are needed to meet any of the purposes set forth in this Notice or any applicable legal requirement or obligation, or while allowed considering any applicable statute of limitations. We will take the necessary steps to destroy or de-identify the Personal Data in our possession when they are no longer needed to meet the above purposes or once the retention periods have ended.
7. Processing Personal Data of a Related Third Party
If, in order to fulfill the purposes described above, Apodaca Processes the Personal Data of third parties related to you (such as your partner or spouse, children, dependents and/or personal references; each a "Related Third Party"), you must share this Privacy Notice with that Related Third Party and obtain their consent for Apodaca to Process and use (including transmit and disclose) their Personal Data according to the purposes described in this Notice.
If you provide us with Personal Data of a Related Third Party, it implies that you have their consent and have made this Privacy Notice available to them as indicated above, so you agree to hold Apodaca harmless from any liability arising from any complaint or claim that such Related Third Party may file against us.
8. Access, rectification, cancellation, objection, questions and complaints
Keep your Personal Data up to date and inform us of any significant changes to your Data or to that of your Related Third Parties by sending an email to [email protected].
You have the right to request access to your Personal Data that are being Processed by Apodaca or any third party acting on its behalf and to know the details of such Processing. You also have the right to rectify, cancel, delete or restrict (as applicable) or to oppose the Processing of your data, always pursuant to the Law, other applicable regulations and laws, and Apodaca's internal guidelines.
To exercise any of the aforementioned rights, you must send your request directly to [email protected]. Your request must include:
- Your name and address or any other means to communicate the response to your request.
- Documents proving your identity or, where applicable, your legal representation.
- A clear and precise description of the personal data for which you are exercising the corresponding right.
Apodaca will inform you, through the contact means you provide in your request, whether it was accepted within a maximum of 20 business days from the date on which the corresponding request was received.
9. Use of "Cookie" technology on our official platforms, applications and websites
Apodaca's official websites, applications and platforms use files known as "cookies". Cookies are small text files that each website, application or platform stores locally on your computer or electronic device.
Cookies and similar technologies are sometimes necessary to remember your account settings, language and country, but they also allow us to measure and analyze your behavior on our website, applications and official platforms, as well as to show you personalized advertising on our platforms and on third-party sites.
Once you have given us your consent to use cookies or when you access any Apodaca website, application or platform, we will store a cookie on your mobile device to remember this for the next visit. If you wish to withdraw your consent for our cookies, you may do so at any time by deleting our cookies through your browser settings.
10. User consent
The Data Subject, under oath, states that they are aware of the contents of this Notice and, by accessing or otherwise using Apodaca's official websites, applications and platforms, participating in events and/or acquiring the services marketed through them, gives their consent through the following statement:

11. Changes to the Notice
This Privacy Notice may be modified, changed or updated due to new legal requirements, our privacy practices, our own needs for the products or services we offer, or for any other reason.
Apodaca undertakes to keep you informed about any changes to this Notice by posting a visible note on this website and/or on any other Apodaca page, platform and/or application; likewise, any interested party may request the current Privacy Notice by emailing [email protected].
